Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Persona Doctors ("Company," "we," "us," or "our") concerning your access to and use of our website, mobile applications, and medical weight loss services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

Eligibility

To use our Services, you must:

• Be at least 18 years of age
• Be a resident of a state where we are licensed to provide medical services
• Have the legal capacity to enter into a binding agreement
• Provide accurate and complete information during registration
• Not be prohibited from using our Services under applicable law

Account Registration

To access certain features of our Services, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and secure
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate your account if any information provided is false, inaccurate, outdated, or incomplete.

Billing and Payment

Payment Terms

• All prices are in US dollars unless otherwise stated
• Payment is required at the time of service or as outlined in your treatment plan
• We accept major credit cards and other payment methods as displayed at checkout
• You authorize us to charge your payment method for all fees incurred

Subscription Plans

Some of our Services are offered on a subscription basis. By purchasing a subscription:

• You authorize recurring charges at the stated intervals
• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account or by contacting us
• Cancellation takes effect at the end of the current billing period

Refund Policy

After the 30-day guarantee period, refunds are provided at our discretion on a case-by-case basis. Refund requests should be submitted in writing to billing@personadoctors.com.

Cancellation Policy

Appointment Cancellations

• You may cancel or reschedule appointments up to 24 hours before the scheduled time
• Cancellations made less than 24 hours in advance may incur a cancellation fee
• Repeated no-shows may result in account suspension

Service Cancellation

You may cancel your enrollment in our program at any time. Upon cancellation:

• No further charges will be processed
• Access to online services will continue until the end of your current paid period
• No refunds will be issued for partial months or unused services (except under our money-back guarantee)
• Prescription medications in your possession remain your responsibility

Intellectual Property

All content on our website and applications, including text, graphics, logos, images, software, and other materials, is the property of Persona Doctors or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or trade dress without authorization
• Reverse engineer or attempt to extract source code from our applications
• Use automated systems to access our Services

User Conduct

When using our Services, you agree not to:

• Provide false or misleading information about your medical history
• Attempt to obtain medications for others or without a valid prescription
• Harass, threaten, or abuse our staff or other users
• Interfere with the proper functioning of our Services
• Violate any applicable laws or regulations
• Share your account credentials with others
• Use our Services for any unauthorized commercial purposes

Limitation of Liability

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services
• Our total liability for any claims arising from these Terms or your use of our Services shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any delays or failures in our Services due to causes beyond our reasonable control

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Persona Doctors and our officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through our Services

Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to first contact us at legal@personadoctors.com and attempt to resolve the dispute informally for at least 30 days.

Arbitration

If we cannot resolve a dispute informally, any dispute arising from these Terms or our Services will be resolved through binding arbitration in accordance with the American Arbitration Association's rules. Arbitration will be conducted in Virginia unless otherwise agreed.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. For material changes, we will provide additional notice, such as an email notification.

Your continued use of our Services after any changes indicates your acceptance of the modified Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
